Application and Validity

Tauchshoponline.ch and Tauchshopluzern.ch provides its customers, hereinafter referred to as "customers", with a wide range of products and services. These General Terms and Conditions regulate the rights and obligations of Tauchshopluzern.ch and Tauchshoponline.ch towards their customers. The following conditions apply exclusively, unless other conditions have been agreed with the customer in writing. All additional agreements, changes and additions to the General Terms and Conditions must be in writing to be valid. Should individual provisions or parts thereof be or become ineffective or invalid, the validity and effectiveness of the remaining provisions remain unaffected. The respective statutory regulations take the place of the invalid provisions.

Orders

Orders can be made online via Tauchshoponline.ch or on site at Tauchshopluzern.ch. When ordering, please always include your telephone number and e-mail address so that we can reach you quickly if we have any questions.

Orders and orders for pickup

Ordered goods or service and repair orders that are to be picked up at Tauchshopluzern.ch and have been agreed upon must be picked up within 30 days of verbal or written notification. Shipping will only take place by post upon advance payment and prior agreement.

If the goods, service or repair orders are not collected within 3 months of the first collection request, the items will either be disposed of or, if the storage costs are not covered, sold to cover the storage costs.

After the 30 day collection period, we reserve the right to collect storage costs upon collection.

Prices

Since Tauchshoponline.ch and Tauchshopluzern.ch are heavily dependent on international circumstances, such as exchange rate fluctuations and unforeseeable economic developments, we may be forced to make price adjustments. Therefore, all of our prices are without guarantee. We strive to always offer you as a customer the best prices.

If you have ordered an item that is now higher in price, we will inform you of this. You can pay the difference or cancel the order.

The price information in our online shop is not binding. The purchase contract is only concluded when we accept your order and ship the item(s). If we reject the order, no purchase contract will be concluded.

The prices in the online shop Tauchshoponline.ch may differ from the prices in the Tauchshopluzern.ch store. If this is the case, there is no right to a refund of the difference.

The prices stated include the statutory Swiss value added tax (VAT). When shipping goods abroad, Swiss VAT does not apply.

Delivery / payment conditions

We ship against prepayment, invoice and accept bank or postal transfer, payment with Twint, PayPal, Visa, Mastercard and American Express. Shipping costs will be charged in addition to the item price. If you choose the "collection" option, you can save on shipping costs, but it does not release you from paying in advance.

Order on account

Ordering on account is only possible in Switzerland. Please note that we only offer delivery on account for existing invoice customers. The surcharge for payment by invoice is 5% of the total amount of your order. After a credit check has been carried out, we will send the goods against an invoice with a payment term of 10 days. If the payment deadline is not met, we reserve the right to only deliver against advance payment.

Shipping costs Switzerland
Within Switzerland, shipping costs up to 10 kg are a flat rate of CHF 12.-. From an order value of CHF 500.-, delivery is free of charge.

This excludes lead, diving cylinders, compressors and all items heavier than 10 kg. This is calculated based on the effective weight. If the package measures over 60 x 60 x 100 cm and is heavier than 10 kg, we will charge the effective postage or the bulky goods surcharge in advance.

Shipping costs Europe

The shipping costs are a flat rate of CHF 38.- resp. CHF 44.- for packages up to 2 kg and a package size of: length, width and height together maximum 90 cm, but not more than 60 cm in any dimension. This excludes lead, diving cylinders and compressors. This is calculated based on the effective weight. If the package is heavier than 2 kg and larger than the above dimensions, we will charge the effective postage or the bulky goods surcharge in advance.

Shipping costs worldwide

The shipping costs are a flat rate of CHF 60.- for packages up to 2 kg and a package size of: length, width and height together maximum 90 cm, but not more than 60 cm in any dimension. This excludes lead, diving cylinders and compressors. This is calculated based on the effective weight. If the package is heavier than 2 kg and larger than the above dimensions, we will charge the effective postage or the bulky goods surcharge in advance.

Important

Prices can change at any time. Shipping costs Europe and worldwide: since our ordering system does not automatically calculate whether your order is within the above package dimensions/weight, we reserve the right to charge the missing amount if the shipping costs are higher.

Processing fees / customs fees / foregin VAT
When a shipment is delivered abroad, the foreign postal administration charges the recipient in the destination country a processing and customs fee and the statutory VAT. We have no influence on these fees. These fees must be paid by the recipient.

Transfer of risk
The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport or has left our warehouse for shipping. Liability claims (e.g. damage, loss, delays, non-delivery, etc.) must be asserted with the carrier.

Delivery terms

In any case, delivery is subject to the availability or deliverability of the products from the manufacturer. The dimensions in Tauchshoponline.ch and Tauchshopluzern.ch are approximate. We reserve the right to make small, customary or technically unavoidable deviations in quality, shape and color that do not significantly affect function and appearance. The images of the items may differ from the original product.

The goods remain the property of Tauchshoponline.ch or Tauchshopluzern.ch in Lucerne Switzerland until full payment has been made.

Delivery times

We do not have any inventory listed on our website. We generally deliver within 3-8 working days (not including Saturday, Sunday). Delivery times may be longer if an item needs to be reordered from the supplier or the supplier cannot deliver immediately.

　

　

Delivery delays

If an item is not immediately available, we will do our best to deliver the goods to you as soon as possible. However, there is no entitlement to this.

If a delivery is delayed beyond a delivery date expressly guaranteed in writing by Tauchshoponline.ch or Tauchshopluzern.ch, the customer can, after expiry of an additional period of at least three weeks to be set by him in writing, put Tauchshoponline.ch or Tauchshopluzern.ch in default and subsequently withdraw from the order in question after a reasonable grace period has expired.

Tauchshoponline.ch or Tauchshopluzern.ch is in no way liable to the customer in this case.

In the event of delivery delays due to circumstances over which Tauchshoponline.ch or Tauchshopluzern.ch has no influence, such as strikes, material failures, transport or operational blockages at the manufacturer, transport problems or others, Tauchshoponline.ch or Tauchshopluzern.ch is entitled to cancel the order.

Order changes or cancellations requested by the customer require a written agreement with Tauchshoponline.ch or Tauchshopluzern.ch. Tauchshoponline.ch or Tauchshopluzern.ch can charge the customer for costs that have already been incurred. If the customer orders several items at the same time and one or more items are not in stock, delivery to the customer will be delayed until all items are ready for shipment. However, Tauchshoponline.ch or Tauchshopluzern.ch reserves the right to make partial deliveries and charge the postage accordingly.

Acceptance and testing

The customer is obliged to check the products and services delivered by Tauchshoponline.ch or Tauchshopluzern.ch for completeness and accuracy immediately after delivery or collection. Any damage, defects or complaints must be reported to Tauchshoponline.ch or Tauchshopluzern.ch immediately and in writing by email within 5 days.

If notification is not made in a timely manner, any warranty and any other claims of the customer will expire, unless the damage or defect was not detectable during the required initial inspection.

Exchange and return policy

We offer you an exchange and return policy. If an item does not meet your requirements, we will take it back within 7 days, unused, in its original packaging, with a copy of the invoice and in perfect condition.

Excluded are: vouchers, swimsuits (for hygienic reasons), diving computers, regulators, buoyancy compensators, diving watches, diving tanks, compressors, diving lamps, accumulators, batteries, underwater photography items, optical glasses, swimming goggles as well as special offers, promotions or liquidations.

Procurement products (ordered specifically for the customer or marked "on order", "not a stock item") cannot be exchanged, returned or refunded. Errors such as publishing or specifying an incorrect image, incorrect price or errors in the text do not entitle you to a refund.

Returns

Since we not only have to pay the postage but also additional fees for shipments that are not sufficiently franked, we ask for your understanding that we can only accept shipments that are sufficiently franked.

Before you send an item back for an exchange or return, you must contact us in advance so that the next steps can be discussed. If returns are not agreed upon, we reserve the right to deduct or offset any expenses from your payment.

The return is carried out at the customer's expense and risk.

Unless otherwise agreed, items returned for credit will be reimbursed in the form of a voucher. A cash payment or refund is excluded. If the item has already been used or is no longer in its original condition, the value will be reduced accordingly. We reserve the right to charge processing fees.

Please keep the return receipt for proof. If the shipment is lost by the carrier, the receipt will be required for an investigation or in the event of liability claims.

The delivery costs for an exchange are borne by the customer and will be invoiced to the customer before shipping.

Order cancellations

If you have placed an order in error, you can cancel the order within 48 hours. If you cancel the order later than 48 hours, we reserve the right to deduct or offset any expenses from your payment.

If your order is already in transit, cancellation is not possible.

Non-acceptance of our shipment

If you do not accept our shipment or do not collect it from the post office, you will be charged the following costs: our shipping fees, return fees and any processing fees.

Warranty

The guarantee or warranty is normally 24 months for new products, 6 months for batteries and is based on the information provided by the manufacturer/supplier. The customer can only assert warranty claims against the manufacturer/supplier, but not against us or our employees. The manufacturer/supplier alone determines the further procedure in the event of a guarantee or warranty.

Improper use or normal wear and tear are excluded from the warranty. If an alleged warranty case does not turn out to be such, Tauchshoponline.ch or Tauchshopluzern.ch can invoice the resulting activities. In the event of a warranty claim, the goods will be repaired or replaced free of charge by the manufacturer at its sole discretion.

Reduction or rescission and further claims for damages are excluded.

Please keep the invoice or receipt as proof. Any shipping costs are not covered by the guarantee and can be charged to the customer.

Liability

Orders for items that are used for diving with scuba diving equipment or for special water sports above and under water require an appropriate diving certification or corresponding completed diving training or special training. We decline any liability resulting from a lack of diving training, a lack of specialist knowledge, improper handling, failure to observe inspection intervals, etc.

Tauchshoponline.ch or Tauchshopluzern.ch are only liable for direct damage and only if the customer proves that this was caused by gross negligence on the part of Tauchshoponline.ch or Tauchshopluzern.ch, third parties commissioned by them or their employees. Liability is limited to the price of the respective delivery or service.

Any further liability of Tauchshoponline.ch or Tauchshopluzern.ch, third parties commissioned by them or their employees for damages of any kind is excluded. Under no circumstances will the customer be entitled to compensation for damage that did not arise from the product itself, e.g. loss of production, loss of use, loss of data, loss of orders, loss of profits as well as indirect or consequential damages.

In any case, returns must be made to Tauchshopluzern.ch, Zürichstrasse 66, 6004 Lucerne.

Late payment

Late payments will be processed according to the usual procedure and handed over to our debt collection agency.

We reserve the right to change the terms and conditions at any time.

Errors, price changes and printing errors reserved.

All data without guarantee. All prices are in Swiss Francs.

Only Swiss law applies. The place of jurisdiction is Lucerne Switzerland.
